The law, which went into effect on May 9, 2018, makes it illegal for employers to discriminate against individuals based on their current or past unemployment status when making hiring decisions or during the course of employment. Under the NYCHRL, it is now unlawful to discriminate against someone because they: Have been or are currently unemployed; Have been or are currently seeking employment; or Have a limited work history or gaps in their employment history. The law applies to all employers with four or more employees, including temporary, seasonal, and part-time workers. It also covers job applicants and current employees. The NYCHRL provides several remedies for individuals who have been subjected to discrimination based on their unemployment status, including: Back pay and benefits; Emotional distress damages; Punitive damages; and Attorney’s fees and costs.
