The law requires employers with five or more employees to provide up to four days of paid sick leave per year, and employers with fewer than five employees to provide up to 40 hours of unpaid sick leave per year. Under the law, employees can use sick leave for themselves or a family member’s illness, injury, or medical care, including preventive care such as physical exams and vaccinations. Employees can also use sick leave if they or a family member are experiencing domestic violence, sexual assault, or stalking. Employers must display a notice informing employees of their rights under the ESTA, which can be found on the New York City Human Rights Commission’s website. Additionally, employers must maintain records of employee work hours and sick leave usage for at least three years. The ESTA applies to all employees who work at least 80 hours within New York City limits during a calendar year, regardless of where they live.
